Work is increasingly being shaped by digital systems, including artificial intelligence, algorithms, automation, and online platforms. From allocating tasks and setting performance targets to monitoring workers and informing workplace decisions, these technologies are becoming part of everyday work and changing the nature of work health and safety risks. In response, NSW has introduced the Work Health and Safety Amendment (Digital Work Systems) Act 2026 – the first law of its kind in Australia to expressly recognise that digital work systems can create risks to workers’ health and safety and are subject to the same WHS regulatory framework as physical workplaces, equipment and work processes.
